One of the good things about New York State is every person who has a car has car insurance. Has something called uninsured or under insured coverage. So your insurance will protect you. If the other person has no insurance you’ll make a claim under your insurance for the uninsured claim which means you won’t be able to go after that person cause or at least not to go after their insurance but your insurance will cover you.
If they don’t have enough insurance, you have something called “under insurance”, which if you have a significant policy, you would collect first from the person’s insurance carried up to the maximum amount of their limits and then you could still bring claim against your insurance carrier for the value of your case minus what you have already gotten from the first car that was the fault of the accident.
