Second Jury Clears Mascot in Hot-Dog-Flinging Case
John Coomer, who filed an appeal after losing his 2010 case against the Kansas City Royals, once again left the courtroom without a settlement in his favor. While attending a Royals game in 2009, Coomer took a foil-wrapped hot dog to the face after it was thrown by the ball team’s mascot, known as Sluggerrr.
The first jury found Coomer to be at fault, but the appeals court jury ruled that no one was negligent in the unfortunate incident that left Coomer with a detached retina in one eye. The fan, who has accrued around $16,000 in medical bills for his injured eye, was understandably disappointed in the recent ruling.
Coomer has no plans for a second appeal. Baseball-shenanigans expert The San Diego Chicken could not be reached for comment.
